Head-on Collision

While driving near Tampa, Florida, our client was struck head-on by a van that crossed the center line, resulting in permanent paraplegia and amputation of his left leg. The van was driven by an employee of a company that transported cars across Florida for hire. In most states, including Indiana, any recovery for our client would have been limited to the case against the transport company. However, under Florida law, the “dangerous instrumentality rule” states the owner of a vehicle becomes vicariously liable for the negligence of the driver. The owner of the van was a leasing company owned by a large car rental company. The combined insurance coverage was sufficient to compensate our client for injuries and damages.
